These Terms & Conditions govern the use of the Eliza Artkats website and the purchase of artworks and related products through the site and at Eliza Artkats studio openings. By accessing this website or making a purchase, you agree to these Terms.

2. Use of This Website
You agree to use this website for lawful purposes only and not to engage in any conduct that may damage, disable, or interfere with the website or its content.
All content on this website is provided for personal, non-commercial use unless otherwise agreed in writing.
3. Artworks & Product Descriptions
All artworks and objects are handcrafted, either individually or in small batches.
Natural variations in colour, texture, and detail are inherent to the artistic process.
Images are provided as an accurate representation; however, colours may vary depending on screen settings.
Measurements and descriptions are provided in good faith.
These characteristics do not constitute defects.
4. Pricing & Payment
All prices are listed in Australian Dollars (AUD) and include GST where applicable.
Full payment is required at the time of purchase.
Payments are processed securely through Squarespace and its nominated payment providers.
EA reserves the right to correct pricing or listing errors. If an order is cancelled due to an error, a full refund will be issued.
5. Processing, Shipping & Delivery
Orders are typically processed and dispatched within 3–5 business days to allow time for payment confirmation, careful preparation, documentation, and packaging.
Processing times may vary during exhibitions, studio openings, or peak periods.
Shipping costs are calculated at checkout.
Delivery timeframes are estimates only and depend on the carrier.
In rare circumstances where an item (including originals, prints, wearable objects, or ceramic works known as twilight treasures) becomes unavailable before website updates can be made, EA will notify the collector as soon as practicable and issue a full refund.
Risk of loss or damage passes to the buyer upon delivery. Nothing in this clause limits your rights under Australian Consumer Law.
6. Returns, Refunds & Australian Consumer Law
6.1 Consumer Guarantees
Our goods come with guarantees that cannot be excluded under Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage.
Where a failure is not major, you are entitled to have the goods repaired or replaced.
Replacement will only be offered where a reasonably identical item is available. For one-of-one original artworks, a replacement will generally not be possible and a refund will be provided.
6.2 Change-of-Mind Cancellations (Prior to Dispatch)
Change-of-mind cancellations are accepted prior to dispatch only.
Collectors may cancel an order for change-of-mind at any time before the artwork has been shipped. Once an item has been dispatched, change-of-mind cancellations or returns are not accepted.
This policy applies to all artworks and products, including original works, prints, wearable objects, and ceramic works known as twilight treasures.
This does not affect your rights under Australian Consumer Law.
7. Studio Openings & In-Person Purchases
Purchases made at studio openings are subject to these Terms.
Artworks may be viewed in person prior to purchase. Consumer guarantees under Australian Consumer Law apply equally to in-person sales.
To the extent permitted by law, EA is not liable for loss, damage, or personal injury occurring at studio events except where caused by our negligence or where liability cannot be excluded.
8. Intellectual Property
All artworks, images, text, and content remain the intellectual property of Eliza Artkats unless otherwise agreed in writing.
Purchase of an artwork does not transfer copyright. Buyers may display artworks for personal use but may not reproduce, distribute, or commercially exploit the artwork without permission.
9. Limitation of Liability
To the extent permitted by law, EA is not liable for indirect, incidental, or consequential loss arising from use of the website or purchase of goods.
Nothing in these Terms excludes or limits any rights or remedies available under Australian Consumer Law.
10. Privacy
Personal information is handled in accordance with EA’s Privacy Policy, available on this website.
11. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be subject to the non-exclusive jurisdiction of Australian courts.
12. Updates to These Terms
EA may update these Terms from time to time. The current version will always be available on the website.
